Montana citizens recently voted to legalize the use of recreational marijuana.
What does that mean for you?
CAN I LEGALLY POSSESS MARIJUANA IN MONTANA?
If you are over the age of 21, yes, you can legally possess marijuana in Montana. It is no longer illegal to possess marijuana within the legal limits. Keep in mind that, just as with alcohol, courts can still limit your use of marijuana if you are out on bail or serving a suspended or deferred sentence, or on any kind of parole or probation supervision.
HOW MUCH CAN I HAVE ON ME?
You cannot get into trouble if you have 1 ounce or less of marijuana plant, or a quarter ounce of "marijuana concentrate," which includes tinctures, oils, hash, wax, or "dabs." The method for measuring edibles has not been settled.
IS THIS EFFECTIVE NOW?
As of January 1, 2021, personal possession of marijuana became legal for people over the age of 21 in the amounts specified in the new statutes.
WHERE CAN I BUY IT?
Right now, you still have to have a medical marijuana card to purchase marijuana from a retail outlet, like a dispensary. Recreational sales for non-card holders will not start until October, 2021.
HOW DO I GET IT BEFORE OCTOBER?
You can grow your own, and it is now legal to possess it. Private residences can possess, plant, or cultivate up to four mature plants AND four seedlings. If you are growing your own, any amount of harvested, dry, processed, or manufactured marijuana IN EXCESS of 1 ounce must be "locked away and out of public view." Get yourself a lockbox. If you live with other people over 21, one residence can't have more than twice the number of allowable plants, regardless of the number of adults living in the residence.
If you do not own the place that you live in - you rent, or the owner is allowing you to live there for free, you must have written permission from your landlord or the property owner.
